Welcome to Bunique! The terms “we”, “us” and “our” refer to Bunique. Bunique operates this shop and website, including all related information, content, features, tools, products and services, to provide you, the customer, with a curated shopping experience (the “Services”). Bunique is supported by Shopify Inc., Shopify Commerce Singapore Pte. Ltd or Shopify International Limited, depending on where Bunique is located, which enables us to provide the Services.

The terms and conditions below, together with any policies referenced here (these “Terms of Service”), describe your rights and responsibilities when using the Services. Please read them carefully, as they contain important information about your legal rights and cover matters such as warranty disclaimers and limitations of liability.

By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you should not use or access the Services. These Terms of Service do not limit any rights you may have under applicable consumer protection law or any other statutory rights that cannot be waived.

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence and have given us consent to allow your minor dependants to use the Services on devices you own, purchase or manage. We have made every effort to accurately represent our products and services in our online shops. However, product colours or appearance may differ from how they appear on your screen because of your device and its settings and configuration. We do not guarantee that the appearance or quality of products or services you purchase will meet your expectations or exactly match what is illustrated or reproduced in our online shops. Product descriptions may change at any time, without notice and at our sole discretion. We reserve the right to discontinue any product at any time and may limit, on a case-by-case basis, quantities offered to any person, geographical region or jurisdiction.

3. Orders

When you place an order, you make an offer to purchase and authorise us and our payment processors to charge the full order amount to the selected payment method. Bunique reserves the right to accept or reject your order for any reason, at its sole discretion and in accordance with applicable law. Your order is not accepted until Bunique confirms its acceptance. We must receive and process payment before accepting the order. Review your order carefully before submitting it, as Bunique may be unable to accommodate cancellation requests after acceptance. If we reject, change or cancel an order, we may attempt to notify you through the email address, billing address and/or telephone number supplied when placing it. Returns or exchanges are governed exclusively by our Return and Refund Policy. This does not limit any rights you have under applicable law. You represent and warrant that your purchases are for personal or household use, not resale or commercial export.

4. Prices and billing

Prices, discounts and promotions may change without notice. The price charged for a product or service is the price in effect when the order is placed, as shown in its confirmation email. Before you confirm the order, the total payable price is displayed, including applicable taxes and charges. Delivery costs, when payable, are shown separately before order confirmation, in accordance with the Shipping Policy. Prices published in our online shops may differ from those in physical shops, other online shops or shops operated by third parties. We may occasionally offer promotions on the Services that affect prices and are governed by terms separate from these Terms of Service. If they conflict, the promotion's terms prevail. You agree to provide current, complete and accurate purchase, payment and account information for all purchases. You agree to promptly update your account and other information, including your email address and credit card numbers and expiry dates, so we can complete transactions and contact you as necessary. You represent and warrant that (1) you are authorised to use the payment method provided; (2) the information supplied for that method is true, accurate and complete; (3) charges incurred will be honoured by your payment provider; and (4) you will pay the charges incurred at the displayed prices, including shipping and handling charges and applicable taxes, where relevant.

5. Shipping and delivery

Unless stated otherwise, we are not responsible for shipping and delivery delays. All delivery times are estimates and are not guaranteed. We are not responsible for delays caused by carriers, customs processing or events outside our control. To the fullest extent permitted by applicable law, title and risk of loss pass to you when we hand products to the carrier, unless applicable law provides otherwise. We are not responsible for delays or failures caused by events beyond our reasonable control, including carrier or customs delays, natural disasters, adverse weather, labour disputes, supply shortages, utility or telecommunications failures, IT incidents, government action or similar events. Our Services, including but not limited to all trademarks, brands, text, images, graphics, product reviews, video and audio, belong to Bunique, its affiliates or licensors and are protected by United States and foreign trademark, copyright and other intellectual property laws. Product listings are likewise managed and owned by Bunique. Purchasing or receiving a product does not grant or confer intellectual property rights, including any patent, copyright, trademark or other proprietary right, in or relating to the product, its design, software or underlying technology. These rights remain exclusively with Bunique or the original rights holder. These Terms permit personal, non-commercial use of the Services only. You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store or transmit material on the Services without our prior written consent. Unless expressly provided here, nothing in these Terms grants or should be interpreted as granting a licence or other rights under any patent, trademark, copyright or other intellectual property of Bunique, Shopify or a third party. Unauthorised use of the Services may violate intellectual property or other applicable laws. Bunique reserves all rights not expressly granted here. Bunique's names, logos, product and service names, designs and slogans are trademarks of Bunique, its affiliates or licensors. You must not use them without Bunique's prior written permission. Shopify's name, logo, product and service names, designs and slogans are Shopify trademarks. All other names, logos, product and service names, designs and slogans on the Services are trademarks of their respective owners.

7. Optional tools

You may be given access through the Services to customer tools offered by third parties that we do not monitor and over which we have no control or input. You acknowledge that we provide access to these tools “as is” and “as available”, without warranties, representations or conditions of any kind and without endorsement. We assume no liability arising from or relating to your use of optional third-party tools. Your use is entirely at your own risk and discretion, and you should ensure you understand and approve the terms on which the relevant third-party providers supply them. Bunique is supported by Shopify, enabling us to provide the Services. When you use the Services, your device communicates with Shopify's systems to ensure their provision. Section 10 explains how Shopify uses and processes information from these interactions. However, sales and purchases in our shop are made directly with Bunique. By using the Services, you acknowledge that Shopify is not responsible for any aspect of sales between you and Bunique, including injury, damage or loss arising from purchased products and services. You expressly release Shopify and its affiliates from all claims, damages and liabilities arising from or relating to your purchases and transactions with Bunique.

We reserve the right to correct them, change or update information or cancel orders where information is inaccurate, including after an order has been submitted. If we cancel an order after payment has been charged, we will issue any refund required by applicable law.

13.2 You also agree not to: (a) upload or transmit viruses or other malicious code that affects or could affect the functionality or operation of the Services; (b) reproduce, duplicate, copy, extract, sell, resell or exploit any part of the Services; (c) collect or track others' personal information; (d) spam, phish, pharm or use pretexts on the Services; (e) use robots, spiders, scraping techniques, data gathering or extraction tools, automated devices or processes, AI tools (such as agentic AI), or automatic or manual means to access the Services; or (f) interfere with, circumvent or bypass security or authorisation features, robot exclusion headers or other access restrictions. We reserve the right to suspend, disable or close your account at any time without notice if we determine that you have breached these Terms.

14.3 We may limit, including through technical measures, whether and how an Agent accesses, uses or interacts with the Services.

14.4 Agents must: (a) identify every HTTP/HTTPS request as coming from an Agent and disclose its name by including “Agent/[agent name]” in the request's user-agent string; (b) not conceal or obscure that access, use or interaction originates from an Agent, including by (i) imitating human behaviour and interaction patterns, or (ii) completing or bypassing CAPTCHAs or measures distinguishing computer from human use; (c) truthfully answer questions or requests to determine whether interactions come from a human or computer; (d) not circumvent or otherwise avoid measures designed to block, limit, modify or control whether and how Agents access, use or interact with the Services.

15. Termination

We may terminate this agreement or cancel your access to all or part of the Services at our sole discretion, at any time and without notice. You remain liable for amounts due up to and including the termination date. These sections survive termination: Intellectual property, Feedback, Termination, Warranty disclaimer, Limitation of liability, Indemnification, Severability, Waiver; entire agreement, Assignment, Governing law, Privacy Policy and any other provisions that by their nature should survive.

16. Warranty disclaimer

Information presented on or through the Services is provided solely for general information. We do not warrant its accuracy, completeness or usefulness. Any reliance on it is entirely at your own risk. We disclaim all liability arising from reliance on these materials by you, another visitor or anyone informed of their contents.

WE DO NOT WARRANT OR REPRESENT THAT YOUR USE WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE. SOME JURISDICTIONS LIMIT OR DO NOT ALLOW EXCLUSION OF IMPLIED OR OTHER WARRANTIES, SO THIS EXCLUSION MAY NOT APPLY TO YOU.

17. Limitation of liability

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO EVENT SHALL Bunique, OUR PARTNERS, DIRECTORS, OFFICERS, STAFF, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INJURY, LOSS, CLAIM OR DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING LOST PROFITS, REVENUE, SAVINGS OR DATA, REPLACEMENT COSTS OR SIMILAR DAMAGES, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICES OR PRODUCTS PURCHASED THROUGH THEM, OR ANY OTHER CLAIM RELATED TO YOUR USE OF THE SERVICES OR A PRODUCT, INCLUDING ERRORS OR OMISSIONS IN CONTENT OR LOSS OR DAMAGE RESULTING FROM USE OF THE SERVICES OR CONTENT (OR A PRODUCT) POSTED, TRANSMITTED OR OTHERWISE MADE AVAILABLE THROUGH THEM, EVEN IF ADVISED OF THE POSSIBILITY. NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

18. Indemnification

You agree to indemnify, defend and hold harmless Bunique, Shopify and our affiliates, partners, officers, directors, staff, agents, contractors, licensors and service providers from third-party losses, damages, liabilities or claims, including reasonable legal fees, arising from (1) your breach of these Terms or documents incorporated by reference; (2) your violation of law or third-party rights; or (3) your access to and use of the Services. We will notify you of a claim subject to indemnification; failure to notify promptly does not release you unless you are materially prejudiced. We may control its defence and settlement at your expense, including choice of counsel, but will not agree to a settlement imposing non-monetary obligations on you without your consent, which may not be unreasonably withheld. You will cooperate in defending indemnified claims, including providing relevant documents.

19. Severability

If a provision of these Terms is held unlawful, void or unenforceable, it remains enforceable to the fullest extent permitted by applicable law and its unenforceable part is deemed severed. This does not affect the validity and enforceability of remaining provisions. Nothing in these Terms limits rights under applicable consumer protection law or other laws that cannot be waived by contract. If a provision conflicts with such rights, those rights apply.

20. Waiver; entire agreement

Our failure to exercise or enforce a right or provision of these Terms is not a waiver of it. These Terms and any policies or operating rules we publish on this site or concerning the Service constitute the entire agreement and understanding between you and us, govern your use and supersede prior or contemporaneous agreements, communications and proposals, oral or written, including earlier versions of the Terms. Ambiguities in interpretation shall not be construed against the drafting party.

21. Assignment

You may not delegate, transfer or assign this Agreement or your rights or obligations under these Terms without our prior written consent; any attempt is void. We may transfer, assign or delegate these Terms and our rights and obligations without your consent or notice to you.

22. Governing law

These Terms are governed by the laws of the jurisdiction where Bunique is headquartered or incorporated, without regard to conflict-of-law principles. You and Bunique consent to the jurisdiction and venue of courts there, except where prohibited by applicable law, and to those courts' personal jurisdiction. Nothing here limits any right to bring claims in your local courts or rely on mandatory laws applicable where you live.

23. Translations

These Terms of Service are presented in Portuguese. Consumers are not required to use English to contact Bunique or exercise their rights. Any translation is for information and does not limit consumers' legal rights or mandatory rules governing dispute resolution.

24. Headings

Headings in this agreement are included for convenience only and do not limit or otherwise affect these Terms.

25. Electronic communications

By using the Services or placing an order, you agree that we may send transactional and service-related communications electronically, including by email, account notice or publication on the Services. They may concern orders, your account, purchases, returns, these Terms or other Service-related matters. You are responsible for keeping your contact information current.
